CMA LAW: CMA Circular No. (15) of 2026 to All Entities and Persons Addressed by Law No. 7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Executive Bylaws, and their amendments, Regarding the Right to Trade, Sell, and Purchase Shares, Sukuk, and Securities by the Individuals whose Kuwaiti Citizenship has been Withdrawn from the 1965 Census Category

Pursuant to the Council of Ministers Resolution No. (296) issued in its meeting No. (11/2024) held on 19/03/2024, which assigned the Central System for the Remedy of Situations of Illegal Residents in coordination with government entities and the entities it deems appropriate to regulate, amend, and follow up the situations of individuals whose Kuwaiti citizenship has been withdrawn, and to the memo of the Central System received by the CMA on 31/08/2026 regarding the remedy of situations of individuals whose Kuwaiti citizenship has been withdrawn from the 1965 census category, and further to previous circulars, particularly Circular No. (20) of 2025 and Circular No. (23) of 2025, and the clarification issued by the CMA on September 24, 2025, on their regard.
The CMA draws the attention of all licensed persons and entities addressed by Law No. 7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Executive Bylaws and their amendments to the importance of complying with the controls governing the situations of persons whose Kuwaiti citizenship has been withdrawn from the 1965 census category, and those who acquired it with them by virtue of dependency, with regard to the rights and benefits granted to them, as follows:
1. The individuals whose Kuwaiti citizenship has been withdrawn, who previously withheld Article (Five/Third) 1965 census category, and those who acquired it with them by virtue of dependency, are subject to the provisions of Paragraph 7 of the Ministerial Resolution No. (1355) of 2025, to continue practicing the right to trade, sell, and purchase shares, sukuk, and securities in the securities Exchange or securities market by individuals and companies owned by persons whose Kuwaiti citizenship has been withdrawn, as well as the issuances of the Council of Ministers on this regard.
2. Maintaining the validity of the verification and authentication mechanism for personal data and information submitted by this category through the original identity, certificates issued by Central System for the Remedy of Situations of Illegal Residents, or Civil ID issued via the (Kuwait Mobile ID) application, as long as it remains valid, electronically verified, and does not conflict with the governing resolutions and instructions.
Accordingly, the CMA draws the attention of all entities and persons addressed by Law No. 7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Executive Bylaws and their amendments to comply with this Circular.
