CMA LAW: CMA Circular No. (08) of 2026 Regarding Reporting False Information on Beneficial Ownership

Greetings,
Within the framework of enhancing the national efforts of anti-money laundering and combating financing of terrorism, and enhancing the transparency of legal persons and legal arrangements, and ensuring the availability of accurate and updated beneficial ownership record, in accordance with the requirements and recommendations of the Financial Action Task Force (FATF), particularly recommendations No. (24) and (25), and in order to support the effectiveness of the transparency and reduce the misuse of legal persons and legal arrangements to conceal ownership or effective control.
The Capital Markets Authority calls upon all licensed persons to report through the Commercial Registry portal of the Ministry of Commerce and Industry (ereg.moci.gov.kw), any suspected inaccuracies or falsehoods related to the identity of beneficial ownership, using the notification form. This should be completed when the licensed person holds supporting information or documents, and it should be attached upon the submission of the report.
It is worth noting that non-compliance with the aforementioned will subject the licensed person to the penalties stipulated in Law No. 7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities, and its amendments, and Law No. 106 of 2013 Regarding Anti-Money Laundering and Combating the Financing of Terrorism and amendments.
