CMA LAW: Resolution No. (168) of 2022 Regarding Extending the Suspension Period of Trading on AAN Digital Services Holding Company Shares at Boursa Kuwait Securities Exchange

Having Perused:
- Law No. 7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Executive Bylaws and their amendments; and
- CMA Board of Commissioners Resolution passed in its meeting No. (6) of 2022 held on 16/02/2022; and
- Based on CMA Resolution No. (76) of 2022 Regarding Suspending the Shares of AAN Digital Services Holding Company from Trading at Kuwait Securities Exchange issued on 27/04/2022; and
- CMA Board of Commissioners Resolution passed in its meeting No. (40) of 2022 held on 02/11/2022.

The Following Was Resolved:
Article (1):
Article (2) of CMA Resolution No. (76) of 2022 issued on 27/04/2022 shall not be valid, and the suspension period stipulated in the same Resolution is hereby extended to no later than 15/02/2023 so that AAN Digital Services Holding Company can prepare audited financial statements and submit them to the CMA to study them and provide opinion thereon, provided that this shall be the final extension for the Company. The Company shall provide the CMA with a weekly report concerning the developments and procedures the Company undertakes to address the suspension of the share from trading.
Article (2):
The listing of AAN Digital Services Holding Company shall be canceled from Boursa Kuwait Securities Exchange as of 16/02/2023 in the event that the Company does not meet the requirements stipulated in Item (1) and any other upcoming requirements that may affect the resumption of trading of the shares.
Article (3):
The concerned bodies shall execute this Resolution, each within its jurisdiction. This Resolution shall come into force from the date of its issuance.
