CMA LAW: Press Release Amendment to Some Provisions of Module One and Module Five of the Executive Bylaws of Law No.7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and their Amendments

The Capital Markets Authority (CMA) has issued on Thursday July 09, 2026, its Resolution No. (95) of 2026 regarding amendment to some provisions of Module One and Module Five of the Executive Bylaws of Law No.7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and their amendments, in which it amended the definition of “Marketer” and the requirements of licensing the activity of Qualified Securities Broker registered with an Exchange.
The amendment to the definition of “Marketer” aims to include Investment Advisor based on the amendment made to Article (5-2-1) of Module Thirteen (Collective Investment Schemes) of the Executive Bylaws of Law No.7 of 2010 and their amendments pursuant to Resolution No. (18) of 2026 Regarding Issuance of Investment Controls for Multi-Asset Funds and Amendment to Some Provisions of the Investment Controls for Other Funds, in addition to correcting the number of the Article stipulated in Article (1-43-3) of Module Five previously mentioned.

The Capital Markets Authority was established pursuant to Law No. 7/2010, approved by the Kuwaiti Parliament in February 2010. Pursuant to the Law, the CMA shall regulate and supervise the securities activities, achieve transparency and fairness, observe listed companies’ execution of Corporate Governance regulations, and protect investors from unfair practices which violate the CMA's Law.
Furthermore, the Law's provisions stipulate the supervision of mergers, acquisitions, and disclosure operations. The CMA also aims to provide awareness programs related to securities activities.
